[Mike McGrady, Legislative Counsel]: So since Mike McGrady with legislative council, I'm gonna, walk you through the senate conferees on s 30 five's proposal. The first fact to note is that the senate is proposing to accede to the house proposal of amendment with one further proposal of amendment. It is in that section fifty seven fifty three about the standard for overcoming a nuisance protection. And it would provide the nuisance protection for an ag activity provided for under subsection a shall not apply if the plaintiff demonstrates one or more of the following. Nuisance violation results from the negligent operation of an ag activity. That is not changing. Sub two would change. It would say the ag activity has a substantial adverse effect on health, safety, or welfare based upon objective, documented medical or scientific evidence that the ag activity was the sole cause of the alleged effect. And then on page two, similarly, the ag activity has a noxious and significant interference with the use and enjoyment of the neighboring property based upon objective document and medical or scientific evidence that the ag activity was the sole cause of the alleged interference.
