[Alyssa Black (Chair)]: Hi, welcome. It is May. So we had a couple of things on our agenda. I think we're going to start with, because we're waiting for Led to counsel, and we do have eight sixteen, which Ledged Council actually walked us through yesterday. Let me tell you my thinking and then let me get the consensus of the committee and then see what we can do around this. So I think we walked through the Senate proposal of amendment yesterday, and I think based upon questions and the language, we've had some deep concerns of how it kind of expanded the bill. I don't know how other people feel. I'm not prepared to concur with the Senate proposal of amendment. I am going to straw poll other people. I'm going to straw poll this to see if anyone else concurs or doesn't concur. And at that point, if it's the position of this committee to not concur, I'm prepared to ask for a committee of conference, and we'll have a committee of conference so that you can actually get the language right and work with the Senate. I think that the version that came over from the Senate was worked on very quickly. And also, there were some floor amendments that may have amended it further. And it just doesn't feel I mean, to me personally, it doesn't feel that it was really thought out well. And I don't want to do anything that has unintended consequences. So I am prepared, so if we decide not to concur, we can then straw poll whether or not we'd like to do a committee conference. Have any thoughts about, oh, Keith is here, I forgot to just blathered through this. Go ahead, Frank.
[Francis McFaun (Vice Chair)]: Yeah, talked with some more people and I think that the language went too far in terms of infringing upon interstate commerce and in terms of just basic use of AI that's reading language and trying to chat GPT and all these things just in their basic functioning. I think we need to look at it more and just hopefully it's a quick conference committee.
[Alyssa Black (Chair)]: Yeah, I don't anticipate that it would be a long, drawn out conference committee. I don't either. Think it's, yes, it took things in a direction that I think would potentially prohibit, importantly, clinicians from using digital therapeutics that we need to get patients. But I don't think we're so far off at a committee conference to be able to resolve it. My concern with it was that it seemed to be pretty limits on even if someone did use a tool of AI to just get a referral somewhere or maybe this is the best, that it would actually even limit that sort of information. So I guess I'm Any other thoughts? I just went on to play with it a little bit just to see what came back, because I've never done

[Alyssa Black (Chair)]: And I too am under the infection that what is in the bill goes too far, because it just said something like, Go for a walk. Is that advice?
[Keith (Legislative Counsel)]: According to the new language, yes.
[Alyssa Black (Chair)]: So I do think the language in the bill goes in. I don't think that was intended. Don't think so either. Well, I think that's kind of what it did. Yeah, I agree.
