[Rep. Marc Mihaly (Chair)]: Welcome back, everyone, to House General and Housing. It is still April 8, Wednesday, twenty twenty sixth, and the last thing we're doing this morning before lunch and the floor is meeting with our esteemed council on S 328. So, Cameron, you wanna introduce yourself, then we can talk.
[Cameron Wood (Legislative Counsel)]: For the record, Cameron Wood, officer of legislative council.
[Rep. Marc Mihaly (Chair)]: So S 328, where are we? Do you have an additional draft for us or not? I do not. No, sir. Okay. That is this afternoon's project. I can't imagine why you don't well, why don't we just take a minute and make sure that we're on the same page as you work on this next draft. Okay? That works. I'm gonna go over a few things, everyone, and would you all please chime in when I get it wrong?
[Rep. Joseph Parsons (Member)]: You might be correct. I might just disagree with you.
[Rep. Marc Mihaly (Chair)]: It's the interesting there's giggles, comments. Okay. The most recent changes that we would like in the next draft, BHCV, no, excuse me, Kirsten Murphy, Executive Director of the Vermont Developmental Disabilities Council, proposed language that would allow repurposing a portion of $10,000,000 for developmentally disabled services policy. I ask that that language be sent to you, and of course, it's subject to your detailed investigative legal review. So that's one item. Marc, do you have that, you're in receipt of that?
[Cameron Wood (Legislative Counsel)]: I think this is what, I believe I have it, yes, sir.
[Unidentified Member (House General & Housing)]: There should be another sentence that Kristen was gonna study.
[Rep. Marc Mihaly (Chair)]: Kristen, also we forwarded you an additional proposal by Kristen's
[Unidentified Member (House General & Housing)]: We have personal not forwarded it to you, Actually, as we don't have
[Rep. Marc Mihaly (Chair)]: she sent it, and it was forwarded. Perfect. And it's essentially a section that has the council providing input to VHCb on projects. In addition, you and I discussed, and I confessed our conversation to the committee, that we would put in subsection four or an appropriate place on supportive housing, in section six d four, that we would add some reference to, not only would they give recommendations about future legislative actions, but also funding sources, Kirsten is okay with that, and I suggested that you try in one sentence to throw in the concept of possibly a charge on, acre charge on, why do I keep forgetting the term? Current use. Current use, etcetera, etcetera, that's included in disability housing. So per acre charge on current use associated with second homes, and that it's just one of the things they can look at. You have Emilie Krasnow's is that Emilie, is the resource center language is that what you're referring to?
[Rep. Emilie Krasnow (Ranking Member)]: Yeah. But we're wait Cameron sent it to me, and I said it looked great. But we're just waiting for one final approval from David's office. But if Cameron wants to share the language that he sent to me that I approved, he has my permission. It's very it it's very quick.
[Cameron Wood (Legislative Counsel)]: I can put it in the next draft. Does that make sense? Yeah.
[Rep. Marc Mihaly (Chair)]: Why don't you do that?
[Rep. Emilie Krasnow (Ranking Member)]: Yeah. It's, like, literally, like, two sentence or, like, no, like, a paragraph, but it's it's great.
[Rep. Marc Mihaly (Chair)]: K. So that goes to the draft. We also surfaced with witnesses this morning on the Common Interest Community Report, expanding what they do to not only look at legal issues, but financial lending, and funding compliance issues. The farmworker housing, I think we could use we are going to get testimony tomorrow on the issue of this is not the thing we discussed today. It's the issue of the I think you can use the VHCb language, but we might as well just throw that in. They're taking testimony now, and David Durfee will be here tomorrow. And I was
[Rep. Joseph Parsons (Member)]: there this morning. Okay, alright.
[Unidentified Member (House General & Housing)]: Did they change it up?
[Rep. Marc Mihaly (Chair)]: Did they change it?
[Cameron Wood (Legislative Counsel)]: I just did a quick walk through this morning and talked about the initial assessment that was They were waiting to hear from VHCb after I testified, so I told them just feel free to let me know what the consensus of the committee was if they wanted to make changes after they had driven VHCb.
[Rep. Marc Mihaly (Chair)]: And then there's, of course, the revised VITA language. And that is all that I have. What have I missed, everybody?
[Cameron Wood (Legislative Counsel)]: My understanding is too, is you want to incorporate the other aspects of seven seventy five that were not there, bring those back in.
[Rep. Marc Mihaly (Chair)]: Yeah, I'm afraid that although I'm hoping that we won't ever use it, because I'm hoping that seven seventy five is the vehicle, that you, in the employ of your Senate clients, will put everything in seven seventy five that we put in here. I think we have to. Yeah. And I spoke at some length this morning with senator Clarkson about just that. Joe.
[Rep. Joseph Parsons (Member)]: Bless you.
[Unidentified Member (House General & Housing)]: Thank you.
[Cameron Wood (Legislative Counsel)]: I have a question about section one. Right. 328.
[Rep. Joseph Parsons (Member)]: 328. Yes, sir. Where do we require we require towns to update their housing or their town plan every often?
[Cameron Wood (Legislative Counsel)]: I believe it's eight years. Eight years? I believe so.
[Rep. Joseph Parsons (Member)]: That sounds about right. That was my guess. So are we making any changes to require people to update it sooner than they normally would need to? Yes.
[Cameron Wood (Legislative Counsel)]: Not based on the language that's in 03/28 or July.
[Rep. Joseph Parsons (Member)]: Okay. Some okay. I mean, that's really kinda the crux of my displeasure with this. Two it's twofold. But, mean, it's literally if I don't have any other reason to update my town plan other than to put in these housing targets whether I can hit them or not, I have no other reason. I don't have to do it. No. You don't. I can just sit stagnant for five years
[Rep. Marc Mihaly (Chair)]: or six years. We're being really yes. You're right. That is correct. You you do not have to act sooner than you otherwise would.
[Rep. Joseph Parsons (Member)]: K. I think it's absolutely pointless then to be honest.
[Cameron Wood (Legislative Counsel)]: It is eight years, it's in 4387. All plans, including all prior amendments shall expire every eight years unless they are readopted according to the procedures in section 4,382.
[Rep. Marc Mihaly (Chair)]: Maybe we ought to put in a provision that I have to do it sooner. No. I don't think. I think we could call it we we can name it after you.
[Unidentified Member (House General & Housing)]: Of course, it's good.
[Rep. Joseph Parsons (Member)]: You can name a provision after me. It's called stripping that part out and going back to the other language. Okay. Got it.
[Unidentified Member (House General & Housing)]: I thought this was your change, that
[Rep. Marc Mihaly (Chair)]: you didn't wanna He likes the offering. Yeah.
[Rep. Joseph Parsons (Member)]: No. I like the just sending a report to
[Rep. Marc Mihaly (Chair)]: Yeah. He liked Gathering Yeah. Gathering information.
[Rep. Emilie Krasnow (Ranking Member)]: Certain data,
[Cameron Wood (Legislative Counsel)]: then what is this if I don't have
[Rep. Joseph Parsons (Member)]: to give you the data for six years?
[Unidentified Member (House General & Housing)]: It's a gentle encouragement to think about your housing Okay.
[Rep. Marc Mihaly (Chair)]: What we heard was, in our version, did have a either put it in your l in your housing in your in your plan, or if you can, tell the h tell the bees DHCD. DHCD, why not? And we didn't have time frame on that either. This doesn't do it that way, but what we hear is that VLCT and Alex and the regional commissions are all happy with this language.
[Rep. Joseph Parsons (Member)]: I would love to know why.
[Rep. Marc Mihaly (Chair)]: Love enough for me to get them back in here?
[Rep. Joseph Parsons (Member)]: Or maybe I can see Josh in the hallway where he can come in. But
[Unidentified Member (House General & Housing)]: I mean, we do have time on our calendar in the next
[Rep. Marc Mihaly (Chair)]: two weeks.
[Rep. Joseph Parsons (Member)]: I mean, we sit around brunch lately.
[Unidentified Member (House General & Housing)]: I thought Samantha said I think
[Rep. Marc Mihaly (Chair)]: you should talk to Josh and then let me know. We had testimony. Did we testify? Yeah, we had testimony. Yes or no?
[Unidentified Member (House General & Housing)]: Oh, we did. We made changes, they were not able to, because that was during that week that they had to testify in like 20 different places, so they never came in to testify specifically on this language.
[Rep. Marc Mihaly (Chair)]: Percentage you know changes from Brownfield School?
[Unidentified Member (House General & Housing)]: Because I remember Joe bringing this up.
[Rep. Marc Mihaly (Chair)]: We have to build a
[Rep. Joseph Parsons (Member)]: different language.
[Unidentified Member (House General & Housing)]: Yeah. Oh. Correct. So you all come back to online?
[Rep. Joseph Parsons (Member)]: Yeah. I mean, I don't
[Unidentified Member (House General & Housing)]: Because this doesn't contain any survey.
[Rep. Joseph Parsons (Member)]: No. I think this isn't compatible with what they say they want, which makes me wonder what do they actually want. If you want information of, hey, just let us know if you're having a hard time hitting these housing targets that are given to you. Let us know the constraint, like what's causing that. Give us an idea of what we can do next year or the following year. I don't have to touch my town plan for six, seven years. What the heck is the point?
[Rep. Marc Mihaly (Chair)]: I think it's rotational, but I would suggest at this point that you do have a conversation with Josh and that we could easily have him or someone else back in. Otherwise, Cameron, is there anything else? I do not. Okay. Anything else before we adjourn?
[Rep. Emilie Krasnow (Ranking Member)]: Do we have a minute?
[Rep. Marc Mihaly (Chair)]: We do. We have five minutes.
[Rep. Emilie Krasnow (Ranking Member)]: Wow. Okay. I just wanna give the committee a heads up about one other thing that working on is I'm not sure Cameron's aware of it. I'm not sure what to call it. It's not a study. It's not
[Rep. Marc Mihaly (Chair)]: Oh, it's six zero six. It says six zero six?
[Rep. Emilie Krasnow (Ranking Member)]: Six zero seven.
[Rep. Marc Mihaly (Chair)]: Six zero seven. Yeah.
[Rep. Emilie Krasnow (Ranking Member)]: It's not a study. It's more of a directive slash report situation that doesn't cost any money, but will be in DHCG's jurisdiction to produce some data and information about private equity in Vermont. But I don't have the language yet.
[Rep. Marc Mihaly (Chair)]: But that would go into 03/28.
[Rep. Emilie Krasnow (Ranking Member)]: Cameron?
[Rep. Marc Mihaly (Chair)]: Right?
[Cameron Wood (Legislative Counsel)]: Yeah. I I think that is your intention. Yes, ma'am.
[Rep. Emilie Krasnow (Ranking Member)]: Yeah. And I talked to the commissioner about it too.
[Unidentified Member (House General & Housing)]: Okay. Yeah. Language if it's on our sorry. It's It's it's just You're It's
[Rep. Emilie Krasnow (Ranking Member)]: not adding six or seven. It's 06/00 seven's inspiration. Can you explain it maybe?
[Cameron Wood (Legislative Counsel)]: Yeah. It's just in not not putting 06/2007 into 03/28. It would be requiring the Department of Housing and Community Development to come back to you all with hopefully some information on what other states have done and possibly some information on whether the covered entities that are defined in six zero seven, whether they exist in Vermont, how many, whether they have purchased housing in Vermont. So my understanding from the sponsor from Rutland Krasnow is to keep momentum on the concept moving forward to give you all some more information for next by any engine, if you want to then pick it up and get it moved in.
[Rep. Marc Mihaly (Chair)]: We ran out of time on 06/2007. We took quite a bit of testimony. We ran out of time. It's clear it's not an easy issue, and so this just would give us more information.
[Unidentified Member (House General & Housing)]: And my understanding, Emilie, is that when you talked to the Commissioner, he was in favor of this. It wasn't just a conversation where he said that they were able to do it and definitely willing. Correct?
[Rep. Emilie Krasnow (Ranking Member)]: Yes. With yes. But, obviously, I'll send him the language before I bring it to the committee as
[Rep. Marc Mihaly (Chair)]: well. But yeah. I'm adding that to the three twenty eight possible list here. Okay. Anything else? So at this point, we do not have anything more today. We have the floor, and then we're done. This is just a I'm sure we're gonna look you know, this is just a weird time, you know, we're waiting for other things to happen, and we'll, know, we'll be busy, we'll be very busy soon, but we're not there yet. So, anything from anybody tomorrow, be convened at 09:00, and it will be with David Derby, and I've asked that he have more time, and I think we'll talk him, let him know, we're gonna put him on the spot. And then we're going to have we'll have Cameron's next draft, and we'll have a walk through. I don't think we'll we'll be voting. Take that off. And then we'll have a walk through committee discussion. I hope final discussion and vote on s 89. Okay? We
