[Alice M. Emmons (Chair)]: Hey, welcome to Atholves. This is House Corrections and Institutions Committee. It is Wednesday, May 13. And I've got one thing I want to ask and share with the committee on S 193, which deals with our feasibility plan. Page 27. Seven.
[Unidentified Committee Member]: Is that what I want to do?
[Alice M. Emmons (Chair)]: It'll be one spot. I think that's the only spot. But this is something that we would work with Katie A conversation I had with the chair of judiciary, he shared with me, and he was more clear in terms of really looking more at this sort of feasibility. The monitoring of folks when they're released, the feasibility plan would monitoring would be done by agency of human services or its departments, with the exception of DOC, should not play a role in its operation. That's of the facility, provision of services, internal security, or post release monitoring of any former residence. So the House Judiciary Committee feels that for folks who are released, that the respective departments that have jurisdiction over these folks, which could be Department of Mental Health, could be Dale, they need to work in collaboration with the Department of Corrections to monitor the folks out in the community. And we've been asked to see if he could put some of that language in in the feasibility. So I'm putting that out on the table to see what people are reading because we were really concerned about DOC doing just DOC alone doing the monitoring. This would be where Department of Mental Health and Dale would have the responsibility, but it would be in collaboration with DOC.
[Unidentified Committee Member]: That's good. I still don't understand what that means. I mean, get all the words, but
[Alice M. Emmons (Chair)]: I think, and the DOC would not be the main driver here. It would be the respective departments where the folks are underneath, like Department of Mental Health or DOC, but they can ask for help from DOC. And DOC would provide some security.
[Unidentified Committee Member]: We're just putting this in the feasibility.
[Alice M. Emmons (Chair)]: The feasibility.
[Unidentified Committee Member]: Write up on how they would need it.
[Alice M. Emmons (Chair)]: Right. They've gotta come back with a plan on how they envision that to occur. So I need
[Mary A. Morrissey (Member)]: to tell you if I'm excited afraid that we come back or whoever comes back in January, we're almost gonna be at the same place for the
[Unidentified Committee Member]: I don't doubt that.
[Alice M. Emmons (Chair)]: Doubt it for a minute. So my question
[Unidentified Committee Member]: you talk to me about feasibility exam. That's okay.
[Alice M. Emmons (Chair)]: Hang on one conversation here. When when
[Unidentified Committee Member]: did you talk about what that look like? You does that mean, like, DMV, for example? Or is
[Alice M. Emmons (Chair)]: it They didn't talk with Okay.
[Unidentified Committee Member]: No. Not that specific.
[Alice M. Emmons (Chair)]: They just want DOC for Okay. It. Some level when it's needed.
[Unidentified Committee Member]: No problem in my mind though, James. That is what I was curious. I would assume, but I just didn't know if that was part of the conversation. Thank you.
[Alice M. Emmons (Chair)]: I mean, it's more complicated of DOC's part just based on the folks that were here last session when we did pretrial supervision, how complicated it is. You can have those conditions of release that are set by another entity. And the DOC supervises for those conditions, but they're not the ones who set those particular conditions. But there are conditions that DOC sets based on their administrative procedure for some of this. And nobody's talking about that, but we talked at length about that
[Mary A. Morrissey (Member)]: two years ago. This is a study under the name of piece of my unfortunate and being negative, and I don't mean to. I'll hope for the best.
[Alice M. Emmons (Chair)]: We hope for the best. And I shared with Martin our thinking this morning of what we talk about the interim, and also with Teresa. I just spoke with Teresa about this too, about how do we take care of the folks who are there now, and justice oversight, the agency of human services needs to come back to us for Justice Oversight, couple three times of session with a proposal on how do they plan to do this in the budget, the money that's needed, and the proposal for budget adjustment come January for those.
[Mary A. Morrissey (Member)]: Move in agreement to look at the possible making about the state for the interim period of time.
[Alice M. Emmons (Chair)]: No one's weighed in on that. They've seen the language, and I we haven't heard any kickback on that for that. So Mary, Conor, and I, I hope Conor hasn't left the building, are gonna meet with Katie. In the cafeteria. I spoke to Katie. She may be tied up with another member right now, but she's gonna come over when she's available. So the three of us will work with Katie, and we'll also include language in the feasibility plan for the monitoring in the community. Okay? And so I would recommend, I am going to say 09:00 tomorrow morning. Hopefully we can have some language before us.
[Mary A. Morrissey (Member)]: Oh, we won't be till tomorrow. We'll take the members of the conference committee in the senate.
[Alice M. Emmons (Chair)]: We won't be until Thursday. That's tomorrow.
[Unidentified Committee Member]: Tomorrow. Good.
[Alice M. Emmons (Chair)]: We well, it depends if they take it up tomorrow. Could be tomorrow. Could be Friday.
[Unidentified Committee Member]: Sizing them up, Mary? Because you Well Sizing them up? Sizing them wanna pieces?
[Mary A. Morrissey (Member)]: We ship it over. I think there's one in the kitchen.
[Unidentified Committee Member]: Other You're good.
[Mary A. Morrissey (Member)]: Troy will have to give me some pointers.
[Unidentified Committee Member]: Very good.
[Alice M. Emmons (Chair)]: Yeah. We'll set you straight. Uh-huh. So I don't know. We could meet we could be ready to meet in conference on Friday or might not be till Tuesday. The chair of the conference committee is Wendy. So we didn't want
[Mary A. Morrissey (Member)]: to sit there just so that you're meeting this weekend. I didn't think so, but
[Alice M. Emmons (Chair)]: Wouldn't be the first. I've been here. The the first. I've Numerous years as you have. Yeah. I've been here. Conference committee meeting on a Saturday. Nobody else in the building in May. Tell you, it wasn't good. Wasn't good. Okay. We're done on YouTube. Done today. Let's plan on 09:00 tomorrow.
