[Michael Marcotte (Chair)]: Hey. Good afternoon, everyone. This is the Vermont House Committee on Commerce and Economic Development. Again, Tuesday, 03/10/2026 at 02:45 in the afternoon or 03:45. In any event, the clerk has advised me that the question is divisible, and so we can divide the question and vote on them separate. Also, just a clarification, I thank our legislative council that if we leave section three and they're talking about contracts without doing anything, then that is a loophole that allows them to contract, continue to contract over and above the one tenth. If we just take it right out, then it would become 110%. Or if we go with the language that AM is proposing after January 1, 07/01/2026, then it would become 110%, any contracts after that. Do I have that right? Yes. Thank you. So I'd entertain a motion on first instance of amendment. So moved. And what is what are we moving? Are we reporting favorably or unpaid? So I think we I think the question should be motion to report favorably on the first instance of amendment. First instance is the one that should not allow. Yeah. Correct. Right. So we can vote against it. Yeah. Okay. Sorry. Were Two talking at the same time. I missed what that was. The first instance is? Is the subsection three reseller? Means a person engaged in a resale of tickets except for except that reseller does not include an individual reselling a ticket purchased for personal use for a single event. That's the first instance of amendment. Thank you. So there's a motion to report favorably on that first amendment. Is there a second? I'll second. K. It's been motioned and seconded. This will be by a show of hands. This is a straw vote. Is there any Can you clarify what if someone votes yes versus what? No. No. So So the motion is to report favorably. So if you want this most if you want this amendment to to go through, you vote yes. If you don't wanna see this to go through, you vote no. So so all those in favor, raise your hand. All those opposed, raise your hand. Did you have her hand? She's guarded. Okay. So the motion is defeated zero eleven zero. And so now the second motion, we need to report favorably in the second instance of amendment. This is in subsection three. The subsection shall not apply to the resale of the ticket under a written contract with the ticketed chief issuer. The resale of tickets at a price greater than a 110% of the price of the original ticket if the written contract is executed prior to 07/01/2026. Is there a motion to report favorably on that amendment? I'll make a motion. K. Is there a second? I'll second. K. Is there any further discussion on this? So all those in favor, raise your hand. Or I just no. I'll vote in favor, raise your hand. So How many is We just remember that if we if we defeat this one, that means that it opens the door for them to contract over and above 110% within the other venue. All those in favor? One, two, four. And all opposed? Oh, wait. Was Edye five? I think Edye was five. Edye was yeah, that's right. Five. Okay. And one, two, three, four, five, six. So that motion is defeated as well. Five, four, six against. Five, six, zero. Right. Okay. K. So you have that. Make sure you have Just in case did it. Sorry. This will come up on the 4th Floor. So the amendment, when it comes up, I think it'll be it'll be divided. And so you can give the vote on the first one, and you can give the reason why. And then on the second one, it was a divided committee as well. Okay. Committee. All. David, I think you can't hear from nothing. We don't have another couple of bills to Well, we could talk to David for a while, to be honest. Okay. Committee, thank you. That's it for today. Tomorrow, we have CT at 09:00. House Education is gonna join us via Zoom for the first hour of that discussion. So any questions? The 05:12 will be up to call for action. There's reading. Go through the amendments.
